About these terms
These terms apply to all work carried out by Clearform Studio. They are written in plain English on purpose. Nothing here removes rights you have under the Australian Consumer Law. Where anything below conflicts with the ACL, the ACL wins.
GST
Clearform Studio is not currently registered for GST, so no GST is charged and none can be claimed back on our invoices. If we become registered, you will receive 30 days written notice before GST is added to your pricing.
Managed plan
Nothing to pay up front, then $149 per month, with a 12-month initial term from the launch date. After that it continues month to month and you can cancel with 30 days written notice. The 12-month term exists because we carry the cost of the build for you. If you cancel during the initial term you pay either the remaining months or a $890 build-out fee, whichever is less.
Flexible plan
A $890 setup fee, then $149 per month with no minimum term. Cancel any time with 30 days written notice and no exit fee. The website, inclusions and support are identical to the Managed plan.
Buyout plan
A one-off $2,950, invoiced 50% on acceptance and 50% on launch. You own the finished website and all source files outright on final payment. Includes 30 days of post-launch support for bugs and minor tweaks. An optional Care Plan at $39 per month covers hosting, updates, backups and 20 minutes of content edits.
Content edits
The monthly plans include up to 45 minutes of content edits per month, and the Care Plan includes 20 minutes. That covers text, photos, prices, hours, services, contact details and reviews. It does not cover new pages, new features, redesigns or integrations, which are quoted separately. Requests are acknowledged within one business day and actioned in a weekly batch. Urgent faults are fixed the same day. Unused minutes do not roll over. Additional work is $140 per hour, always quoted before we start.
Build timeline
Standard builds launch in seven to ten business days from the discovery call. The clock pauses if content or photos are not supplied within 48 hours of request, if more than two rounds of design revisions are requested, if credentials are outstanding, or if scope expands mid-build. It restarts when the blocker clears. If a project sits inactive on your side for 30 days we will invoice work completed to date at $140 per hour and close it.
Revisions
Two rounds of design revisions are included. A round means one consolidated set of changes, not individual requests trickled in over several days. Additional rounds are $290 each.
Growth services
The Local Search Setup is a one-off $890, payable on acceptance and delivered within 10 business days of receiving access. The Growth Plan is $249 per month with a three-month minimum, then month to month. Advertising management is an additional $240 per month with a three-month minimum, plus a one-off setup fee. Minimum advertising spend is $1,000 per month for Google and $600 per month for Meta. You pay the advertising platform directly and we never mark up ad spend.
Design phase guarantee
If we cannot arrive at a design you are happy with during the design phase, before the build begins, anything you have paid is refunded and the agreement ends. Once the build has started this guarantee no longer applies.
Results
We do not guarantee search rankings, traffic, lead volume, cost per lead, conversion rates or revenue. Those depend on your market, your competitors, your pricing, your reviews and how quickly you respond to enquiries. We do guarantee that the work described in your proposal is delivered, that your site meets the stated performance standard, and that we report honestly on what is and is not working.
What you provide
Your logo files, photographs, business details, service list, any existing copy, and access to your domain and Google Business Profile. You confirm you have the right to use everything you supply, and you indemnify us against claims arising from material you provided.
Payment
Monthly plans are charged by direct debit on the same date each month. One-off work is invoiced 50% on acceptance and 50% on delivery unless agreed otherwise. Invoices are due within 14 days. Work pauses on accounts more than 14 days overdue after 7 days written notice, and services may be suspended beyond 30 days overdue after written notice. Third-party costs such as domains, email hosting, advertising spend, stock imagery and premium fonts are your responsibility and are passed on at cost.
Ownership
Your domain, logo, photographs, business content and all accounts created for you are yours from day one and are registered in your name. Website source files transfer to you on final payment for the Buyout plan, immediately on the Flexible plan, and after 12 months of payments on the Managed plan or by paying the $890 build-out. Clearform Studio retains ownership of its reusable component library, design system and internal tooling, which are not part of your site.
Portfolio
We may display your website and describe the work in our portfolio and case studies. Tell us in writing if you would prefer we did not, and we will not.
Cancellation
Notice is given by email to our business address. On cancellation you keep your domain, your content, all accounts held in your name, your Google Business Profile, any advertising accounts and your form submission history. We will provide a reasonable handover of access at no charge.
Privacy
We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. See our Privacy Policy for detail.
Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law. Where the ACL applies and the law permits us to limit liability, our liability is limited to re-supplying the services or paying the cost of having them re-supplied. Otherwise our total liability is limited to the fees you paid in the preceding three months. We are not liable for indirect or consequential loss, or for outages caused by third-party providers such as hosting, domain registrars or advertising platforms.
Changes to these terms
We may update these terms with 30 days written notice. Continuing to use the service after that period means you accept the change. Pricing for existing clients is locked for the duration of any minimum term.
Governing law
These terms are governed by the laws of Queensland, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Queensland.
